Terms of Service

These Terms of Service ("Terms") govern your use of "GATE CAM" ("the App"), provided by an individual developer ("the Developer"). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to all provisions of these Terms. If you do not agree, please do not use the App.

2. About the App

The App is an iOS video camera application developed and provided by an individual developer. It offers features including video recording, color grading, and frame export.

The App is a general-purpose recording tool. The manner and purpose of its use are left entirely to the user's judgment and responsibility. The Developer does not monitor or control how users use the App and accepts no responsibility for the results of such use.

3. Usage Guidelines

When using the App, please observe the following:

• Comply with the rules of any location you are filming in and all applicable laws.
• Do not film in ways that invade another person's privacy.
• Do not use the App for voyeurism or any other illegal recording activity.
• Do not use the App for purposes contrary to public order and morals.
• Verify and respect the portrait rights, privacy rights, and copyright of subjects. When filming people, obtain their consent where required.

4. Responsibility for Use

The App is intended for use with content you have filmed yourself or have legitimate rights to use. You must not infringe any third party's copyright, trademark, portrait rights, privacy rights, or any other rights while using the App.

5. User Responsibility

The App provides tools for recording and editing. All responsibility for how those tools are used rests with you.

• The Developer accepts no liability for any outcome arising from your use of the App, including the content of recordings or claims by third parties regarding recording activities.
• The Developer accepts no liability for the management, storage, use, publication, or deletion of videos and photos captured with the App.
• If you cause damage to a third party by violating these Terms or applicable law, you shall resolve the matter at your own cost and shall not cause any loss or damage to the Developer.
• If the Developer suffers loss as a result of your illegal conduct, you shall compensate the Developer for such loss.

6. Minors

Use of the App assumes that you have the legal capacity to agree to these Terms. If you are a minor (under 18 in Japan), please obtain parental or guardian consent before using the App.

7. Prohibited Activities

The following activities are prohibited:

• Illegal recording using the App (including voyeurism, unauthorized filming, and conduct in violation of laws prohibiting the filming of sexual imagery).
• Reverse engineering, decompiling, or disassembling the App.
• Reproducing, modifying, distributing, or otherwise making secondary use of all or part of the App.
• Using the App to create or distribute content that infringes the copyright, portrait rights, or privacy rights of third parties.
• Using the App to create illegal content, including obscene material or child sexual abuse material.
• Unauthorized access to the App or any action that places excessive load on the system.
• Circumventing or disabling security features of the App.
• Any other act that violates applicable law or public morals, or that causes harm to the Developer or any third party.

8. Intellectual Property and License

All intellectual property rights in the App (including copyrights and trademarks) belong to the Developer. LUTs (color looks), frame overlays, fonts, UI designs, and other materials provided within the App are either:

• Owned by the Developer,
• Licensed to the Developer under a valid license, or
• Provided under an open-source license (such as the SIL Open Font License).

You must use these materials in accordance with applicable law and the relevant license conditions. These Terms grant you a limited, non-exclusive license to use the App. All intellectual property rights in the App remain with the Developer or its licensors. Copyright in videos and photos you capture using the App belongs to you.

9. In-App Purchases

Certain features (such as Gate Cam+ features) are available through In-App Purchase via Apple Inc. Pricing, payment processing, refunds, and other transaction matters are governed by Apple's terms and the App Store policies. For billing inquiries, please contact Apple first.

10. Price Changes

The price and feature set of the App may change in future updates. Where changes occur, we will endeavor to notify you via update notes or similar means.

11. Service Interruption and Termination

The Developer may temporarily suspend or terminate all or part of the App without prior notice due to system maintenance, technical issues, force majeure (natural disasters, communication failures, etc.), or other reasonable cause. The Developer is not liable for any loss caused to users as a result.

12. Compliance with Recording Laws

Laws and regulations governing recording vary by country, region, and location. You are responsible for verifying and complying with all applicable laws where you record (including anti-voyeurism laws, portrait rights, privacy laws, and facility rules).

The Developer is not in a position to provide legal advice regarding where or when recording is permitted. Please consult a qualified professional if legal guidance is required.

13. Limitation of Liability

To the maximum extent permitted by law, the Developer's total liability under these Terms shall not exceed the amount you actually paid for the App. During any period when the App is provided free of charge, the Developer's liability is zero.

14. Third-Party Services

The App runs on Apple's iOS platform. The Developer is not responsible for any impact on the App's functionality caused by OS updates, changes to Apple's policies, or other third-party actions.

15. Support and Updates

The Developer does not guarantee the provision of support or updates. Support and updates are provided at the Developer's sole discretion.

As an independently developed app, support capacity is limited. While inquiries are welcome, individual responses are prioritized for critical bugs and security issues. Other inquiries may be considered resolved upon receipt. Thank you for your understanding.

16. Disclaimer of Warranties

The App is provided "as is" without warranty of fitness for a particular purpose, completeness, continuity, or freedom from defects (bugs or errors).

• To the maximum extent permitted by law, the Developer is not liable for any direct, indirect, incidental, or consequential damages arising from use or inability to use the App.
• The Developer accepts no liability for loss, corruption, or failure to save recording data. Please back up important data yourself.
• Certain features may be unavailable or behave differently depending on your device model, OS version, or settings.
• App updates may add, change, or remove features without prior notice.
• The Developer is not liable for issues or damages caused by factors outside its control, such as network conditions, device state, or OS specification changes.

17. Changes to These Terms

The Developer may revise these Terms as necessary. When material changes are made, the revision date on this page will be updated and we will endeavor to notify you via an in-app notice. Continued use of the App after changes constitutes acceptance of the revised Terms. If you do not agree to the changes, please stop using the App.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
